Recently, a report detailing the failure of the California State University system to deal with Title IX complaints has led to new bills signed by Governor Gavin Newsom that address sexual harassment and violence on college campuses.

Title IX in California?

Title IX is a federal civil rights law enacted in 1972 that ensures that all students, regardless of gender, have equal access to educational resources and opportunities. This includes not only sports but also academic programs, financial aid, and extracurricular activities. 

Title IX also addresses issues of sexual harassment and assault, requiring schools to have procedures in place to investigate and resolve complaints, and to protect students from retaliation.

What are the Title IX Bills Signed by Gov. Newsom?

A 2023 state audit found that the California State University system failed to address sexual assault allegations, often closing cases improperly. 

In addition to a disturbing frequent change of Title IC Compliance Officer leadership, the audit also discovered that 10 administrators and 79 faculty members, coaches, and staff across 12 campuses were disciplined or resigned between 2017 and 2021 for Title IX violations.

In response to these discoveries, Gov. Newsom signed Assembly Bill 1790, which requires the Cal State system to implement recommendations which were outlined in the audit that uncovered these systemic deficiencies in handling these types of allegations. 

He also signed a second bill, Assembly Bill 2608, that mandates that all public higher education institutions in California must include discussions about alcohol- and drug-facilitated sexual assault in their annual sexual violence and harassment training.

These changes would begin in September 2026 and include California State Universities, California Community Colleges, University of California campuses, and higher education institutions that receive state funding.

This is the beginning of a broader legislative effort in California for Title IX sexual harassment allegations. Eleven additional Title IX-related bills are currently under consideration, three of which have gained support from California State Universities leadership. One of the bills calls for establishing a systemwide Office of Civil Rights in order to oversee Title IX offices across all California State University campuses.
