Biden Administration’s New Title IX Revisions Go Into Effect in Some States

Biden Administration's New Title IX Revisions - Hahn Legal Group

New Title IX rules from the Biden administration recently went into effect in several states throughout the U.S.

These regulations broaden the scope of Title IX across the country, extending protection from discrimination based on sexual orientation and gender identity, as well as treatment of pregnant students. These new regulations have gone into effect in many states across the nation, but are blocked in many others due to legal challenges.

At the Hahn Legal Group, our experienced education law attorneys have extensive experience in Title IX cases. Whatever the allegation, a Title IX hearing is serious. It is serious for the accused, the accuser, and the college. If you have been accused of a Title IX offense, or you think your protections have been violated, we are here to help.

What is Title IX?

Title IX is a federal civil rights law enacted in 1972 as part of the Education Amendments. At its core, Title IX prohibits sex-based discrimination in any school or educational program that receives federal funding. While often associated with athletics, its scope is far broader, encompassing all aspects of education.

Some of the key areas covered by Title IX include:

  • Athletics: Title IX ensures equal opportunities for male and female students in sports programs, including facilities, equipment, and scholarships.
  • Sexual Harassment & Assault: Title IX mandates that schools take swift and equitable action to address complaints of sexual harassment or assault. This includes investigations, supportive measures for survivors, and disciplinary actions against perpetrators.
  • Gender Discrimination: Title IX protects students from discrimination based on gender identity, gender expression, and sexual orientation. This includes access to restrooms, locker rooms, and housing consistent with a student’s gender identity.
  • Pregnancy & Parenting: Title IX requires schools to provide reasonable accommodations for pregnant and parenting students, ensuring they have equal access to educational opportunities.

What are the Biden Administration’s New Title IX Updates?

The Biden administration’s recent revisions significantly broaden Title IX. The new regulations extend these protections to include discrimination based on sexual orientation and gender identity, and address unequal treatment of pregnant students.

This expansion means that schools will now face a broader range of complaints they must investigate.

However, the Biden administration is currently embroiled in a legal battle involving these new educational regulations. Attorneys general have challenged these regulations in multiple lawsuits, resulting in a situation where the rules cannot yet take effect in many states.

In response to this legal turmoil, the Biden administration has asked the Supreme Court to step in and provide clarity. The administration is seeking permission for the portions of the regulations that have not been contested to be implemented while it continues to appeal the decisions that have blocked the rule in other states.
